

TERMS & CONDITIONS

These Terms & Conditions (“Terms”) govern the purchase and use of products, services, consultations, installations, maintenance, and other solutions provided by The Auracle Home (“Auracle Home,” “we,” “us,” or “our”).
By requesting a consultation, approving a quotation, paying a deposit or invoice, placing an order, scheduling work, or otherwise engaging The Auracle Home, the customer (“Client,” “you,” or “your”) agrees to these Terms.
1. Our Services
The Auracle Home provides home-resilience and self-sufficiency solutions, which may include consultation, assessment, sourcing, supply, setup, installation coordination, maintenance, and support relating to backup and alternative power, water filtration and management, indoor and outdoor food-growing systems, hydroponics, irrigation, air-quality solutions, composting and eco-waste, water gardens and aquatic systems, home preparedness, and related products and services.
Products and services offered may change from time to time.
2. Consultations & Recommendations
Recommendations are based on information available to The Auracle Home at the time of assessment, including information supplied by the Client.
The Client is responsible for providing accurate information concerning the property, intended use, existing electrical or plumbing systems, household requirements, site conditions, and any other information relevant to the project.
Recommendations are intended for the property and circumstances assessed and should not be assumed to apply to another property or situation.
Where work requires a licensed electrician, plumber, engineer, contractor, or other qualified professional, The Auracle Home may require or recommend that such work be completed or approved by an appropriately qualified person.
3. Quotations & Scope of Work
Unless otherwise stated, quotations are valid only for the period specified in the quotation.
Prices and availability may change before a deposit is received due to supplier pricing, shipping, customs duties, taxes, exchange rates, product availability, or other costs outside our reasonable control.
Once accepted, the quotation and/or written scope of work will identify the products and services included in the project.
Any work, equipment, modification, upgrade, or service outside the agreed scope may result in additional charges and may require Client approval before proceeding.
4. Deposits
A minimum deposit of 50% of the quoted project or order value is generally required before an order, project, or installation is confirmed.
Certain projects may require a deposit of up to 80%, particularly where the project involves imported equipment, special-order or customized products, high equipment or material costs, significant upfront procurement expenses, or other project-specific commitments.
The applicable deposit will be disclosed before payment is required.
No equipment is required to be ordered and no project date is guaranteed until the required deposit has been received and cleared.
5. Payment Processing Through The Garden Kat
Payments relating to The Auracle Home products, consultations, projects, installations, or services may be received or processed under The Garden Kat, which is used by the business for payment administration.
Accordingly, The Garden Kat may appear on payment instructions, bank-transfer information, receipts, invoices, transaction records, payment confirmations, or financial statements associated with an Auracle Home transaction.
Where a Client makes payment using payment details officially provided by The Auracle Home or The Garden Kat for an Auracle Home transaction, that payment will be recognized and applied to the applicable Auracle Home order, invoice, project, or service.
Clients who are uncertain about payment instructions should confirm the details directly with The Auracle Home before sending funds.
6. Remaining Balance
The remaining balance will become due according to the payment schedule stated in the Client's quotation, invoice, or project agreement.
The Auracle Home may require full payment of outstanding balances before final installation, delivery, commissioning, activation, handover, or completion.
We may pause work, withhold delivery, or postpone installation where an amount that has become due remains unpaid, subject to applicable law.
7. Cancellations, Deposits & Refunds
Because many Auracle Home solutions involve consultation time, planning, procurement, imported goods, special orders, customized equipment, reserved installation time, or other upfront commitments, payments may become non-refundable once costs or obligations have been incurred on the Client's behalf, to the extent permitted by applicable law.
Where appropriate and agreed by The Auracle Home, an eligible payment or credit may be transferred toward another available Auracle Home product or service instead of being refunded.
Special-order, customized, imported, used, installed, opened, altered, or Client-specific products may not be returnable or exchangeable except where required by law or expressly agreed in writing.
Nothing in these Terms excludes or limits any refund, remedy, warranty, right, or protection that cannot lawfully be excluded under the laws of The Bahamas.
Any separate Refund, Exchange & Cancellation Policy published by The Auracle Home forms part of these Terms.
8. Product Availability & Substitutions
Products shown, discussed, quoted, or recommended are subject to availability.
Where a specified item becomes unavailable, discontinued, materially delayed, or commercially impractical to obtain, The Auracle Home may propose a reasonably comparable alternative.
No material substitution will be made without informing the Client where the substitution materially affects the price, functionality, appearance, or agreed scope.
9. Shipping, Importation & Delays
Some products may be sourced internationally.
Estimated delivery and installation dates are estimates unless expressly guaranteed in writing.
The Auracle Home will not be responsible for delays reasonably outside our control, including delays caused by manufacturers, suppliers, freight carriers, customs, ports, severe weather, hurricanes, natural disasters, utility interruptions, shortages, government action, labour disruption, or other events beyond our reasonable control.
10. Site Access & Client Responsibilities
The Client must provide reasonable and safe access to the property at agreed times and disclose known conditions that may affect the project.
Additional work made necessary by previously undisclosed or reasonably unforeseeable site conditions may result in additional charges.
The Auracle Home may postpone or refuse work where site conditions create an unreasonable safety risk or prevent the work from being properly performed.
11. Electrical, Plumbing & Structural Work
Certain systems may require electrical, plumbing, structural, permitting, engineering, or other specialist work.
Unless specifically included in writing within the agreed scope, such work is not automatically included in an Auracle Home quotation.
The Client may be required to obtain approvals, permits, professional assessments, or third-party services before installation can proceed.
12. Product & System Performance
System performance depends on numerous factors, including equipment specifications, installation conditions, maintenance, weather, sunlight, water quality, utility conditions, user behaviour, plant health, and environmental conditions.
Accordingly, The Auracle Home does not guarantee uninterrupted power, particular crop yields, exact reductions in utility costs, absolute water purity, complete self-sufficiency, or any other specific performance outcome unless that guarantee is expressly provided in writing.
13. Maintenance & Proper Use
Clients are responsible for operating and maintaining systems according to provided instructions, manufacturer requirements, and recommended maintenance schedules.
Failure to perform appropriate maintenance, unauthorized modification, misuse, neglect, unsuitable environmental conditions, or work performed by an unauthorized third party may affect system performance and applicable warranty coverage.
Maintenance plans or ongoing support are included only where expressly stated in the applicable agreement.
14. Manufacturer Warranties
Certain products may carry warranties provided directly by their manufacturer or supplier.
Unless expressly stated otherwise in writing, third-party manufacturer warranties remain subject to the manufacturer's own terms, exclusions, procedures, and warranty periods.
The Auracle Home does not independently extend a manufacturer's warranty beyond the coverage provided by that manufacturer unless expressly agreed in writing.
Nothing in this section limits statutory rights that cannot lawfully be excluded.
15. Damage, Alterations & Third-Party Interference
The Auracle Home is not responsible for damage, malfunction, reduced performance, or failure resulting from misuse, neglect, accidents, unauthorized alteration, improper maintenance, pest or animal damage, weather events, utility conditions, pre-existing property defects, or work subsequently performed by third parties, except to the extent liability arises from The Auracle Home's own acts or omissions and cannot lawfully be excluded.
16. Limitation of Liability
To the fullest extent permitted by applicable law, The Auracle Home will not be liable for indirect, incidental, special, or consequential losses arising from the use, interruption, failure, or unavailability of a product or service.
Nothing in these Terms excludes or restricts liability where doing so would be prohibited by applicable law.
17. Photographs & Project Content
The Auracle Home will not publicly use identifiable photographs or videos of a Client's private property for marketing purposes without appropriate permission.
Where permission is granted, project photographs or videos may be used for portfolios, websites, social media, advertising, educational materials, or other business marketing.
Clients may decline marketing use of their property images.
18. Intellectual Property
The Auracle Home's branding, original written materials, designs, proposals, consultation materials, photographs, graphics, processes, and other proprietary content remain the property of The Auracle Home or their respective rights holders, as applicable.
Providing a proposal, design, recommendation, or consultation does not transfer ownership of The Auracle Home's proprietary business materials or intellectual property unless expressly agreed in writing.
19. Privacy
Personal information collected through the website, consultations, quotations, orders, installations, or communications will be handled in accordance with The Auracle Home's Privacy Policy and applicable data-protection law.
20. Website Information
Information provided on The Auracle Home website or social-media accounts is provided for general informational purposes and does not constitute a site-specific professional assessment.
Images may be illustrative. Products, specifications, pricing, availability, and services may change.
21. Force Majeure
The Auracle Home will not be responsible for failure or delay in performing obligations caused by circumstances reasonably beyond our control, including hurricanes, storms, flooding, fire, natural disasters, epidemics, utility failures, transportation interruptions, port or customs delays, government restrictions, labour disruptions, supply-chain interruptions, or similar events.
Where reasonably possible, affected obligations will resume once circumstances permit.
22. Refusal or Termination of Service
The Auracle Home reserves the right, subject to applicable law, to refuse, suspend, or terminate service where there is non-payment, unsafe working conditions, abusive or threatening conduct, fraudulent activity, material breach of an agreement, unlawful requests, or circumstances that make continued performance impracticable or unsafe.
Any financial obligations following termination will be determined according to work performed, goods ordered or supplied, costs reasonably incurred, these Terms, and applicable law.
23. Governing Law
These Terms and any transaction or agreement with The Auracle Home shall be governed by the laws of the Commonwealth of The Bahamas.
The parties should first make reasonable efforts to resolve disputes directly and in good faith before pursuing other remedies available under applicable law.
24. Changes to These Terms
The Auracle Home may update these Terms from time to time.
The Terms applicable to a particular transaction will generally be those in effect when that transaction or agreement is entered into, unless the parties subsequently agree otherwise or applicable law requires otherwise.
25. Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
26. Entire Agreement
These Terms, together with the applicable quotation, invoice, scope of work, accepted proposal, and any policies expressly incorporated into the transaction, constitute the agreement between The Auracle Home and the Client regarding that transaction.
Where a project-specific written agreement expressly conflicts with these general Terms, the project-specific provision will apply to that project to the extent of the conflict, subject to applicable law.
27. Acceptance
By paying a deposit or invoice, approving a quotation or proposal, placing an order, or authorizing The Auracle Home to begin work, the Client confirms that they have read, understood, and agreed to these Terms & Conditions.
